Terms of Service

Please read these terms and conditions carefully before using the UBUDDY platform. By accessing our services, you agree to be bound by these terms.

Between UBUDDY and the User

Acceptance of Terms

By accessing and using UBUDDY's school management platform ("Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to these Terms of Service, please do not use our Service.

These terms apply to all visitors, users, and others who access or use the Service, including but not limited to school administrators, teachers, students, and parents.

Important: By clicking "I Agree" or by using our Service, you acknowledge that you have read, understood, and agree to be bound by these Terms.

Use of Service

2.1 Eligibility

You must be at least 18 years old or have parental consent to use this Service. By using UBUDDY, you represent and warrant that you meet these eligibility requirements.

2.2 Account Registration

To access certain features, you must register for an account. You agree to:

Provide accurate, current, and complete information during registration
Maintain and promptly update your account information
Maintain the security of your password and account
Accept responsibility for all activities under your account
Notify us immediately of any unauthorized access

2.3 Acceptable Use

You agree NOT to use the Service to:

Violate any applicable laws or regulations
Infringe upon the rights of others
Transmit malicious code, viruses, or harmful software
Attempt to gain unauthorized access to any systems or networks
Interfere with or disrupt the Service or servers
Collect or store personal data about other users without consent

Intellectual Property Rights

The Service and its original content, features, and functionality are owned by UBUDDY and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and use the Service for your school management needs. You may not:

Copy, modify, or create derivative works of the Service
Reverse engineer, decompile, or disassemble any part of the Service
Remove or alter any proprietary notices or labels
Use the Service to develop competing products or services

Data and Privacy

Your use of the Service is also governed by our Privacy Policy. Please review our Privacy Policy to understand our practices regarding the collection, use, and disclosure of your information.

4.1 Your Data

You retain all rights to the data you input into the Service ("Customer Data"). By using the Service, you grant UBUDDY a license to use Customer Data solely for providing and improving the Service.

4.2 Data Security

We implement appropriate security measures to protect your data. However, no method of transmission over the Internet is 100% secure. You acknowledge that you provide data at your own risk.

Payment and Subscription

5.1 Subscription Plans

UBUDDY offers various subscription plans. By subscribing, you agree to pay the applicable fees for your chosen plan.

5.2 Billing

Subscription fees are billed in advance on a recurring basis
Fees are non-refundable except as required by law
We reserve the right to change pricing with 30 days notice
Failure to pay may result in suspension or termination of service

5.3 Cancellation

You may cancel your subscription at any time through your account settings. Cancellation will be effective at the end of your current billing period.

Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including:

Breach of these Terms of Service
Non-payment of subscription fees
Conduct that violates applicable laws
Prolonged inactivity of your account

Warning: Upon termination, your right to use the Service will cease immediately. We may delete your data after a grace period.

Limitation of Liability

To the maximum extent permitted by law, UBUDDY shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or other intangible losses resulting from:

Your use or inability to use the Service
Unauthorized access to or alteration of your data
Any conduct or content of third parties on the Service
Any interruptions or errors in the Service

Our total liability shall not exceed the amount you paid to UBUDDY in the 12 months preceding the claim.

Indemnification

You agree to indemnify, defend, and hold harmless UBUDDY, its officers, directors, employees, and agents from any claims, losses, damages, liabilities, and expenses (including attorney fees) arising from:

Your use of the Service
Your violation of these Terms
Your violation of any rights of another party
Any content you submit or transmit through the Service

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page and updating the "Effective Date" above.

Your continued use of the Service after changes become effective constitutes your acceptance of the revised Terms. If you do not agree to the new Terms, you must stop using the Service.

Stay Informed: We recommend reviewing these Terms periodically for any updates.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.

Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts located in Ahmedabad, Gujarat, India.
